Terms of Sale

Article 1 — Scope

These Terms of Sale ("Terms") govern all purchases made on the KAP company online store (kap.company). By placing an order, the customer expressly accepts these Terms in full. KAP company reserves the right to update these Terms at any time; the version in force at the time of the order shall apply.

Article 3 — Products

KAP company sells limited-edition caps and related objects produced in collaboration with artists. Each product description specifies available sizes, colourways, and edition quantities where applicable. Products are offered subject to availability. KAP company reserves the right to withdraw any product from sale at any time.

Article 4 — Orders

Orders are placed via the online store. An order is confirmed upon receipt of a confirmation email from KAP company. KAP company reserves the right to cancel or refuse any order in the event of an out-of-stock situation, a payment issue, or suspicion of fraud. In such cases, the customer will be notified promptly and any payment already taken will be refunded in full.

Article 5 — Pricing

All prices are displayed in euros (EUR) inclusive of applicable French VAT. KAP company reserves the right to modify prices at any time. The price applicable to an order is the price displayed at the time the order is confirmed. For international orders, additional customs duties, taxes, or import fees may apply and are the sole responsibility of the customer.

Article 6 — Payment

Payment is due in full at the time of ordering. KAP company accepts payment by credit card and any other methods displayed at checkout. All transactions are processed securely via Shopify Payments. KAP company does not store payment card data.

Article 7 — Delivery

Orders are shipped worldwide via UPS. Processing time is 2–5 business days from order confirmation. Estimated delivery times are indicative only and do not constitute a guaranteed delivery date. KAP company cannot be held liable for delays caused by the carrier, customs authorities, or circumstances beyond its control.

Shipping costs are calculated at checkout based on destination and order weight.

Article 8 — Transfer of Risk

Risk of loss or damage to products passes to the customer upon delivery to the address provided at the time of ordering. In the event of a lost or damaged shipment, the customer must notify KAP company at contact@kap.company within 7 days of the expected delivery date.

Article 9 — Right of Withdrawal

In accordance with French law (Article L221-18 of the Code de la consommation) and EU Directive 2011/83/EU, customers residing in the European Union have the right to withdraw from their purchase within 14 days of receiving their order, without providing any reason.

To exercise this right, the customer must notify KAP company at contact@kap.company within the 14-day period. Items must be returned in original, unused condition and in original packaging. Return shipping costs are borne by the customer except in cases of defective or incorrectly delivered items.

Refunds will be processed within 14 days of receipt of the returned item, using the original payment method.

The right of withdrawal does not apply to customised or made-to-order items.

Article 10 — Defective or Incorrect Items

If a product is received damaged, defective, or different from what was ordered, the customer must contact KAP company at contact@kap.company within 7 days of delivery, including photographic evidence where applicable. KAP company will arrange a replacement or full refund at its discretion, including return shipping costs.

Article 11 — Intellectual Property

All products sold by KAP company are produced in collaboration with artists and are protected by copyright. Purchase of a product confers no rights over the underlying artwork beyond personal use. Any reproduction, distribution, or commercial exploitation of the artwork is strictly prohibited without prior written consent.

Article 12 — Limitation of Liability

KAP company's liability is limited to the value of the order placed. KAP company cannot be held liable for indirect damages, loss of profit, or any harm resulting from misuse of a product. Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud.

Article 13 — Personal Data

Personal data collected during the ordering process is processed in accordance with KAP company's Privacy Policy, available on the website. Data is used solely for order fulfillment and customer communication and is never sold to third parties.

Article 14 — Applicable Law and Jurisdiction

These Terms are governed by French law. In the event of a dispute, the parties will seek an amicable resolution in the first instance. Failing that, the dispute will be submitted to the competent courts of Paris, France.
